Deputy swerves to miss cow, crashes truck

A Saline County sheriff’s deputy responding to a domestic disturbance report in Falun before sunrise Saturday crashed his patrol truck when he encountered a black cow in the road.
Deputy Kristopher G. Kite, 25, was treated at Salina Regional Health Center after he was cut out of the truck, which crashed at 5 a.m., said Sheriff Glen Kochanowski. Kite has worked for the sheriff’s office for more than a year.
Kite was driving about 65 miles an hour west on Falun Road when he saw the cow, Kochanowski said. He swerved in an attempt to miss the animal and clipped the cow’s hind legs. The pickup went into the ditch, then turned sideways and rolled at least once, he said.
Another officer on his way to the call in Falun discovered the crash, checked on Kite’s welfare and then went to Falun.
Kochanowski said he was relieved the deputy’s injuries weren’t more serious. Kite minor scrapes and bruises and injuries to his back. He was protected by his seat belt and air bag.
Kochanowski said rural drivers need to remember the safest thing to do when they come across an animal in the road is to resist the urge to swerve and go ahead and hit the animal. Hitting the animal does less damage and causes fewer injuries than a roll-over crash, he said.
Kochanowski estimated the loss of the 2008 truck at around $25,000. A $5,000 onboard camera, $3,000 computer and radio equipment will be evaluated to determine damage, he said.
Until the insurance claim is settled, Kochanowski said deputies will use a vehicle assigned to the Sheriff’s Office Reserves.

The law in Kansas - and in most other states as well - is "open range" meaning that cattle have free open range and the livestock owner cannot be sued for one single cow being out of the confines. UNLESS, it can be proven that it is HABITUAL. 99.999% of livestock owners in no way want someone hurt of killed because of a cow being out of the fence boundries. Besides the loss of human life, they are losing good money in the loss of the cow. To think that the cow owner should be held responsible is utterly false. The cow owner lost close to $1000.00 with the death of this cow and not counting the unborn calf that she was more than likely carrying along with future calves to be born. The production of this cow is what pays the bills for the owner. Sometimes deer destroy or knock down the fence and sometimes coyote hunters merely drive right through a fence in the pursuit of a coyote.(which is a whole 'nother subject!) This was an accident, pure and simple. Be glad that the deputy was not killed or that a van load of teenagers didn't encounter the unfortunate cow. The last time I knew, Salina was located square in the middle of the cattle/grain heartland and not in the middle of New York City where you can expect these attitudes because of ignorance. I'll bet that most of you can trace your roots right back to a farmhouse. Get real, people!

This was an unfortunate incident and I am glad the Deputy is okay. I say shame on the landowner for not ensure his cow was properly secured. Glad we are only needing a new truck and not paying for a funeral and a replacement Deputy. This is exactly what insurance is for. 12 hour shifts on the road its only a matter of when you are in a wreck, not if, especially given the line of work. Be thankful it was not your family memeber driving down the road and met up with the cow.

Here's a happy solution for all concerned: Slaughter the cow, cook the beef, and serve up $5 BBQ beef burgers as a fund raiser toward getting the sheriff's truck repaired and a fair price to the farmer for his cow. I'm glad the deputy wasn't hurt and in the same situation, I'd head for the ditch too, rather than hit a cow head on.

Kansas needs to change their laws to make farmers responsible for when their cattle get out. Thankfully the Sherrif's deuty was not killed. And I'm sorry Sherrif, but I'd rather hit the ditch than hit the cow. Not quite the same as hitting a deer. And that can be fatal too. Looks like we need a new truck though!

Yeah but the deputy will receive an award from PETA for trying to avoid the cow. PETA should install reflectors along the sides of all black cows, for cases like this.
